2. Using this website
By placing an order you agree to these terms. You must be 18 or older, or have a parent or guardian's permission, to buy. You do not need an account to order. We may change or remove parts of the website at any time, and we do not promise it will always be available or free of errors.
3. Products
- Our pieces are made by hand. Size, colour, glaze, grain and finish vary slightly from piece to piece and from the photographs. These natural variations are part of the product and are not defects.
- We describe and photograph every product as accurately as we can. Colours may look different on different screens.
- Stock is limited, and some items are one of a kind. We may stop selling a product at any time.
4. Prices
- All prices are in South African Rand (ZAR, R) and [include 15% VAT / are not subject to VAT, because we are not VAT registered. Choose one].
- Delivery costs are shown separately at checkout, before you pay. The total you see is the full price you pay.
- If we discover a pricing or stock error after you order, we will tell you. You may then confirm the order at the correct price or cancel it for a full refund.
5. Placing an order
- When you submit an order you are making us an offer to buy. We accept it when we send you an order confirmation by email. If we cannot supply an item we will let you know and refund anything you have paid.
- Please check your order and delivery details before you pay. Tell us quickly if something is wrong and we will fix it if the order has not been dispatched.
- We may decline or cancel an order for a good reason, for example an item is out of stock, an address is outside our delivery area, or we suspect fraud. If we do, we will refund you in full.
6. Payment
- You can pay by card or instant EFT. Payments are processed by Yoco, a South African payment provider, on its own secure payment page.
- Payments are processed by a secure third-party payment provider. We never see or store your full card details.
- We dispatch your order once your payment has cleared. Ownership of the goods passes to you when they are delivered and paid for in full.
7. Delivery and collection
At checkout you choose how you would like to receive your order. The cost of each option is shown before you pay and is added to your total.
- PUDO locker: we send your parcel to the PUDO locker you choose, and PUDO lets you know when it is ready to collect. PUDO currently quotes 1 to 3 business days for this service once the parcel has been dispatched.
- Delivered to your door: we drop your parcel at a PUDO locker and PUDO delivers it to the address you give us.
- Collect in Polokwane (free): we contact you to arrange a time and place for you to collect your order. [collection address, days and hours, and how long we keep an order for collection]
- We currently deliver within South Africa only [or list the countries you ship to].
- We aim to have your order ready within [3 to 5] working days. Delivery times are estimates, not guarantees. If we expect a delay we will tell you.
- Risk in the goods passes to you when the parcel is delivered to your address or your chosen locker, or when you collect it from us.
- Please check your order as soon as you receive it. If anything is damaged or missing, contact us within [7] days with your order number and photos so we can put it right.
8. Cancellations, returns and refunds
Your right to cancel (cooling-off). Under section 44 of the Electronic Communications and Transactions Act you may cancel an order, without giving a reason and without penalty, within 7 days of receiving the goods (or of collecting them from us). To do this, email us within the 7 days, then send the item back in the condition you received it, unused and well packed. The only cost you can be charged is the direct cost of returning the goods. We will refund the price you paid within 30 days of your cancellation.
Exceptions. The law does not give a cooling-off right on goods made, altered or personalised to your specific request. We will tell you before you order if an item is made to order.
Faulty goods. Under the Consumer Protection Act you are entitled to goods that are of good quality, free of defects and fit for their normal use. If an item is defective or unsafe, you may return it to us within 6 months of delivery. At your choice, we will repair it, replace it or refund the price you paid, at our risk and cost, including the cost of returning it.
Cancelling before dispatch. Email us as soon as you can. If your order has not been dispatched we will cancel it and refund you.
How refunds are paid. We refund to the payment method you used, or by EFT if that is not possible. Banks and payment providers can take a few working days to show the money.
Return address and process. Email us at the address in section 15 with your order number. We will confirm the return address and how to send the parcel.
9. Care and safe use
Look after your pieces following the care notes on each product page. Handmade pottery can chip or crack if dropped or exposed to sudden temperature changes. [State whether ceramics are food-safe, dishwasher-safe, microwave-safe and oven-safe, and add any warnings about candles, paints or jewelry].
10. Our designs and photos
The designs, logo, text and photographs on this website belong to us or are used with permission. You may not copy or use them commercially without our written consent. Buying a product does not give you any right to reproduce our designs.
11. Your personal information
We handle your personal information as set out in our Privacy Policy, in line with the Protection of Personal Information Act (POPIA).
12. Liability
Nothing in these terms limits any right you have under the Consumer Protection Act or any other law, and nothing excludes liability that cannot lawfully be excluded. Subject to that, and as far as the law allows, we are not responsible for loss that was not a reasonably foreseeable result of our breach, for indirect or consequential loss, or for delays caused by events outside our control, such as courier delays, strikes, power or internet failures and severe weather. This website may link to other sites. We are not responsible for their content.
13. Changes to these terms
We may update these terms from time to time. The version on this page when you place your order is the one that applies to that order.
14. Disputes and the law
These terms are governed by the laws of the Republic of South Africa. If you are unhappy with anything, please contact us first so we can try to sort it out. If we cannot, you may also contact the National Consumer Commission, your provincial consumer protection office, the Consumer Goods and Services Ombud (where we are a member), or the National Consumer Tribunal. You may also go to the Magistrate's Court that has jurisdiction. Nothing in these terms stops you from using these routes.
